1. Australian place of work laws give basic defense and entitlements for all workers in Australia, including workers from out of the country.
2. Every worker from abroad must have a legitimate Australian visa with rights of work in Australia. Temporary visas with work rights comprise working holiday maker visas, student visas and the subclass 457 visa. You can ensure your own work and visa entitlements at www.immi.gov.au.
3. Employers are accountable for checking all workers’ rights to vocation in Australia and might ask to see workers’ passports or other recognition. Employers have to have your consent to check your work rights.
4. Employers cannot terminate visas. Only the Department of Immigration and Citizenship (DIAC) can award, decline or cancel visas. DIAC can give information on visa choices, rights and obligations, including how to alter your sponsor or submit an application for permanent residence.
5. For subclass 457 visa holders, sponsoring employers:
• must give workers from abroad pay and conditions as a minimum equivalent to other workers that are doing the similar work at the same workplace
• must only provide work for personnel from abroad in their approved skilled occupation
• must confirm that workers from abroad do not work for other employers
• cannot give workers in cash
• must pay the go back airfare for abroad workers if requested in writing by you or DIAC
• must not build deductions from workers’ pay (other than tax) devoid of their permission.
6. You do not require employing a Migration Agent to make a visa application. If you do make a decision to use a Migration Agent, you must make sure the agent is registered with the Office of the Migration Agents Registration Authority (MARA).
